Scope of Terms and Conditions

These terms and conditions apply to the use of the online marketplace (hereinafter “service”) provided by Simmes Oy (hereinafter “service provider”) for the rental, listing, and marketing of holiday homes. These terms apply to the use of the service by renters (hereinafter “user”) and to the making of bookings and rental agreements between landlords and users. By using the service, the user accepts these terms and commits to complying with them. More detailed descriptions of the service are available at www.rajamailla.fi

The service can also be used by a minor, but anyone making bookings or rental agreements through the service must be 18 years of age or older. The person renting a cabin to a minor is responsible for the minor, regardless of whether they stay in the same rental property or not.

Contact, Complaints, and Claims Regarding Rental Properties

All contacts, remarks, claims, and complaints related to a rental property must be addressed directly to the landlord of the property. Claims and complaints must be made without delay once the error or other contractual non-conformity has come to the user's attention. The claim must also specify the defects of the rental property or other contractual non-conformities related to the rental.

Changes to Simmes Oy's Service and Terms

The online service provider reserves the right to make changes to these terms and the service. The online service provider will inform users of material changes to the terms and service on its website and/or to service users. Changes will become effective at the stated time. Unless a specific effective date for the change has been defined, the change will become effective when it is made. The online service provider aims to announce material changes to the terms at least 1 month before the change takes effect.

Description of Simmes Oy's Service

The online service is a marketplace offered at www.rajamailla.fi for renting holiday homes and for offering, advertising, and marketing program and food services. An accommodation, program, or food service provider can list their own service, market it to customers, and receive bookings and agree on the provision of the service directly with the user. Similarly, users can search for suitable services, make inquiries, bookings, and agreements directly with service providers.

Use of Simmes Oy's Service

The user agrees to use the service in accordance with these terms, applicable law, and good practice. If the online service provider has reason to suspect that the user has not complied with these terms or applicable law, the online service provider has the right to restrict the user's access to the service or take other measures deemed necessary. The user agrees that the information provided to the online service provider is accurate, sufficient, truthful, and correct.

The user may not (a) use or attempt to use another user's account without the approval of that user and the online service provider; (b) copy, modify, or create derivative works from the service or related technology; (c) disassemble, decompile, or otherwise attempt to discover the source code of the service or its technology; (d) remove intellectual property rights notices from the service; (e) create a user account for the service using another person's personal information or otherwise incorrect or fabricated information; (f) transfer the right to use the service to another without the prior consent of the online service provider; (g) sell, assign, or resell the service and its usage rights without the prior consent of the online service provider.

Parties to Rental Agreements

These terms apply to the use of the rajamailla.fi service, and no agreement other than an agreement on the use of the service in accordance with these terms shall arise between the online service provider and the user in any situation. Any rental agreement for accommodation is formed directly between the user and the landlord; the online service provider is not a party to the rental agreement. The online service provider acts only as an intermediary.

Prices, Bookings, Formation of Rental Agreement, Invoicing, and Key Handover

The current prices for services are listed on the advertisement page for each service in the Rajamailla.fi service. The service provider has the right to correct errors in price information before the order agreement is formed. After the agreement has been formed, the service provider has the right to increase and, conversely, the obligation to decrease the agreed price if taxes or public charges affecting the service price change.

A binding agreement for ordering the service is formed between the user and the service provider when (1) the user has ordered the service, and (2) has paid an advance payment to the service provider, amounting to 25% of the service price. If the total price of the booking is less than 300 €, no advance payment is required, and the user pays the full service price at the time of order. The agreement made is binding and cannot be canceled, terminated, or amended except in accordance with these terms.

Services are ordered online through the Rajamailla.fi service. Bookings are provisionally valid for three (3) days from the booking date.

The user pays the invoice for the full price of the service immediately after making the booking or once the service provider has confirmed the booking. The booking is finally valid and becomes a binding agreement for both parties when the payment is reflected in the service provider's account. If the booking is not paid within three (3) days from the booking date, the booking will expire. However, if payment arrives after this period, a binding agreement is still considered to have been formed, unless the service provider cancels the booking and refunds the payment to the user. If the user wishes to negotiate payment terms, they must contact the service provider.

An invoice will be sent to the email address the user provided when making the booking. It is also possible to receive the invoice by mail. A billing fee of 10 euros will be added to invoices sent via mail.

For accommodation services, the user must arrange key handover directly with the landlord. The key handover contact information will be sent to the user once the rent has been paid. The user must arrange key handover with the key provider well in advance of the booking start date. The key provider acts as the landlord's contact person for any inquiries, feedback, claims, and problems regarding the rental property.

Payment Service Provider

Paytrail Oyj (2122839-7) acts as the implementer of the payment intermediation service and as the payment service provider in cooperation with Finnish banks and credit institutions. Paytrail Oyj will appear as the payee on your account statement or card bill and will forward the payment to the merchant. Paytrail Oyj holds a payment institution license. In case of complaints, please contact the product supplier first.

Cancellation or Modification of Booking by User

The user is entitled to cancel their booking and the agreement based on it under the following conditions. Cancellation must always be made in writing (e.g., email) directly to the service provider. Cancellation is deemed to have occurred at the moment when the service provider received notification of the cancellation. However, if the user can prove that the cancellation was made and sent to the correct address at the correct time, the cancellation will be accepted, even if it was delayed or did not arrive at all due to reasons beyond the user's control. An advance payment specified on the invoice, which is 25% of the booking sum, will always be retained upon cancellation of a booking. If the booking is canceled later than 30 days before the start date of the service, the full rental price will be charged for the cancellation.

Notwithstanding the foregoing, the user has the right to get back the amount paid to the service provider (excluding the advance payment) if the user themselves or a person living in the same household falls ill, has an accident, or dies, and the user cancels their booking before the start of the service. Such a cancellation must also be notified to the service provider without delay. In connection with the cancellation, the user must provide reliable proof of the circumstance entitling to cancellation. If the cancellation occurs during the holiday period, the payment made by the customer will not be refunded.

If the customer wishes to change the date of the service and it is possible for the service provider to implement, a change fee of 30 euros will be charged. The date change must be made at least 30 days before the start of the reserved service. Changes made later than this will be considered a cancellation of the booking and a new booking.

Cancellation of Booking by Service Provider

The service provider is not responsible for any breach of contract, delay, or error caused by an obstacle beyond the service provider's control (force majeure). In such a situation, the service provider may cancel the booking and terminate the contract without liability for compensation. In this case, the user has the right to receive a full refund of the amount paid to the service provider.

Stay and Use of the Rental Property

For accommodation services, unless otherwise agreed, the rental property is available to the user from 16:00 on the arrival day until 12:00 on the departure day. The keys to the rental property are generally handed over to the user at the time the user has previously notified the landlord as their estimated arrival time. The rental property may not be used by more people than stated at the time of booking. The use of a tent or caravan on the holiday property without the landlord's permission is prohibited. Bringing pets to the rental property must be agreed upon separately. Smoking inside the rental property is not allowed without the landlord's prior permission. The user is obliged to compensate the landlord for any damages caused to the rental property or its furnishings. Work time and costs incurred in handling the damage will also be charged to the user. The holiday property is inspected before and after the user's arrival.

Functionality of Simmes Oy's Service and the Information it Contains

Although the online service provider has carefully designed the service, Simmes Oy does not guarantee that the service will operate without errors and interruptions or that the information it contains will be error-free, up-to-date, and accurate. The online service is provided to the user “as is.” The online service may experience interruptions in use or operation due to, among other things, development work, maintenance, and technical issues, and Simmes Oy is not responsible for any inconveniences or damages caused by such interruptions in use or operation.

Simmes Oy is not responsible for the correctness, sufficiency, accuracy, legality, or timeliness of the advertisements presented in the service or the content entered by service providers, as Simmes Oy generally does not verify the content entered by service providers. The service provider is responsible for ensuring that the service is available to the user at the agreed time and that its quality otherwise corresponds to what was agreed.

Devices, Software, and Data Connections

The use of the Rajamailla.fi service requires a terminal device, a web browser, and a data connection. Although the online service has been tested before publication, the online service provider cannot guarantee that the online service will function flawlessly on all possible web browsers, operating systems, and terminal devices. The user is responsible for, at their own expense, having the terminal devices, data connections, and software required for using the online service.

Personal Data and Data Protection

The online service provider processes personal data in accordance with its privacy policy, which is valid at any given time. The privacy policy can be viewed at www.rajamailla.fi

Intellectual Property Rights

The online service (including any changes, updates, and corrections made to it) and its contained materials are works protected by copyright law, the copyright of which belongs exclusively to Simmes Oy or its licensors, from whom Simmes Oy may have licensed the service's content or materials. The online service may also be associated with other intellectual property rights, such as trademarks, patents, and design rights, or trade secrets, which also belong to Simmes Oy or its licensors. Simmes Oy does not transfer any intellectual property rights to the user, but the user only receives a limited right to use the service in accordance with these terms.

Validity of Terms

These terms apply to the user as long as they use the online service. The user may stop using the online service at any time. Simmes Oy may also cease providing the online service permanently or temporarily at any time.

Applicable Law and Dispute Resolution

Finnish law applies to the agreement between the parties, these terms of use, and the use of the service.

All disagreements and disputes between the parties will primarily be sought to be resolved through negotiation. If a resolution is not reached through negotiation within thirty (30) days from when a party has made a written negotiation initiative, disputes will be resolved at first instance in the District Court of Southeast Finland.

However, if a contracting party is a consumer as defined by the Consumer Protection Act, they have the right to file a lawsuit in the district court of the locality in Finland where the consumer has their domicile or permanent residence. Consumers can also use the online dispute resolution service provided by the European Commission, which is available at http://ec.europa.eu/odr. Finnish consumer-users can also turn to the Consumer Disputes Board in case of a dispute (see more: kuluttajariita.fi and kuluttajaneuvonta.fi).

Limitation of Liability

This clause applies only to users who are not considered consumers: Simmes Oy is not responsible for any indirect or consequential damages caused by the use or inability to use the online service, or by breaches of contract, including loss of income or revenue, business interruption, business losses, lost sales, loss or corruption of data, and lost profits. Unless otherwise provided by mandatory legislation, the total maximum amount of Simmes Oy's liability for damages is the total VAT-exclusive sum of payments collected by Simmes Oy from the user during the one (1) month preceding the first claim for damages.

Other Terms

Simmes Oy has the right to use subcontractors in connection with the fulfillment of its contractual obligations. Simmes Oy is responsible for the actions of its subcontractors as if they were its own actions. Upon request, Simmes Oy can provide additional information about the subcontractors it uses.

If the fulfillment of the obligations mentioned in these terms is not possible due to force majeure or other reasons beyond the service provider's control, Simmes Oy is released from its obligations without liability for compensation for the duration of the circumstances preventing the fulfillment of the obligation.

Simmes Oy may, in connection with a corporate or business acquisition or other corporate or business arrangement, transfer the agreement or its individual rights or obligations contained in the agreement to a third party without the user's consent. The user does not have the right to transfer the agreement or their other rights or obligations to any third party, including the right to use the service, without Simmes Oy's prior consent.
